Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

In no case shall EUROPERFUMES, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

You agree to indemnify, defend and hold harmless EUROPERFUMES and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

 

SECTION 15 - SEVERABILITY

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

 

SECTION 16 - TERMINATION

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

 

SECTION 17 - ENTIRE AGREEMENT

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

SECTION 21 - CANCELLATION / RETRACTATION / RETURN / EXCHANGES

21.1 Cancellation of order
To be taken into consideration, any request to cancel an order must be made before dispatch of the products and, at the latest, 24 hours before the date of departure of the package. This cancellation must be notified directly to the Customer Department of Histoires de Parfums by phone: +1-844-276-5766 or by e-mail to uscustomerservice@histoiresdeparfums.com.

21.2 Return of unsatisfactory or damaged products
In the event that one or several products do not comply with the customer's order or are defective or damaged, the customer must immediately inform Histoires de Parfums and return them to it at his/her cost no later than 30 days after delivery of the order. The replacement product(s) will be sent to the customer at the expense of Histoires de Parfums. In the event that the product(s) returned is/are no longer available, Histoires de Parfums will inform the customer and will reimburse him/her for the amount of the said product(s) (not including shipment costs). 

All individual sample vials are final sale.

SECTION 22 - SUBSCRIBER PROMOTION DISCLAIMER 

Use of discounts and/or promotions are only of use and generated through the brand’s newsletter subscriber base. Discount codes and promotions generated by the brand are prohibited for general public use and are only granted to newsletter subscribers via email and SMS notifications respectively. Without qualified or active promotion codes or discounts, all sales will be listed as seen on site. Please see calculated product amounts at checkout.

 

SECTION 23 - GIVEAWAY  

1. Eligibility: Giveaway (the “Giveaway”) is open only to those who enter via Instagram and who are at least 18 years of age as of the date of entry. The Giveaway is only open to legal residents of the United States and is void where prohibited by law. Employees of Histoires de Parfums (the “Sponsor”) their respective affiliates, subsidiaries, advertising and promotion agencies, suppliers and their immediate family members, and/or those living in the same household of each are not eligible to participate in the Giveaway. The Giveaway is subject to all applicable federal, state, and local laws and regulations. Void where prohibited.
2. Agreement to Rules: By participating, you agree to be fully unconditionally bound by these Rules, and you represent and warrant that you meet the eligibility requirements set forth herein. In addition, you agree to accept the decisions of Histoires de Parfums, as final and binding as it relates to the content. The Giveaway is subject to all applicable federal, state, and local laws.
3. Giveaway Period: Entries will be accepted online starting on or about June 22, 2022, at 12:01 a.m. Eastern Time ("ET") and ending on June 23, 2022 at 11:12 p.m. ET (the "Promotion Period").
4. How to Enter:
   At the beginning of the Promotion Period, Sponsor will publish three (1) post on the @HistoiresdeParfumsus Instagram account (https://www.instagram.com/Histoires de Parfumsus/) announcing the Giveaway and inviting entrants to enter the Giveaway (the "Giveaway Post"). To enter, follow the Instagram account, tag three (3) other users within the comment section below the post, and Like the entry (1) photo on the feed that are for the Giveaway Post. Entrants will receive one (1) entry into the Giveaway. The Comment must not include text or subject matter that is deemed by the Sponsor to be objectionable. All entries must be received by the end of the Promotion Period in order to participate. The Sponsor's database clock will be the official time keeper for this Giveaway. Tampering with the entry process or the operation of the Giveaway is prohibited and any entries deemed by Sponsor, in its sole discretion, to have been submitted in this manner will be void. In the event a dispute regarding the identity of the individual who actually submitted an entry cannot be resolved to Sponsor's satisfaction, the affected entry will be deemed ineligible.
   Except as otherwise contemplated in these Official Rules, and to the extent entrants may otherwise elect at the time of entry, personal information collected in connection with the Giveaway will be used in accordance with Sponsor's privacy policy located at https://usa.histoiresdeparfums.com/policies/terms-of-service. If you use fraudulent methods or otherwise attempt to circumvent the rules your submission may be removed from eligibility at the sole discretion of Histoires de Parfums.
5. Winner selection and notification:
   At the end of the Promotion Period, up to the first eleven (11) accounts to Comment on the Giveaway Post will be designated potential winners. Winner selection will be conducted by the Sponsor or its designee, using randomization methods selected by the Sponsor in its sole discretion. A potential winner will be notified by direct message using the contact information given at the time of entry. Histoires de Parfums US shall have no liability for a winner’s failure to receive notices due to winners’ spam or other security settings or for winners’ provision of incorrect or otherwise non-functioning contact information. If the selected winner cannot be contacted, is ineligible, fails to claim the prize within 72 hours from the time award notification was sent, or fails to timely return a completed and executed declaration and releases as required, prize may be forfeited and an alternate winner selected.
   The receipt by winner of the prize offered in this Giveaway is conditioned upon compliance with any and all federal and state laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY ANY WINNER (AT SPONSOR’S SOLE DISCRETION) WILL RESULT IN SUCH WINNER’S DISQUALIFICATION AS WINNER OF THE GIVEAWAY AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.
6. Prizes:

No cash alternative or substitution of prizes will be allowed, except Sponsor reserves the right in its sole discretion to substitute prize(s) of comparable value if any prize listed is unavailable, in whole or in part, for any reason. Applicable portions of prizes will be delivered only to an address in the United States.
   Many will enter, only one (1) will win. Actual odds of winning depend on the number of eligible entries received.  Actual/appraised value may differ at the time of prize award. The specifics of the prize shall be solely determined by the Sponsor. No cash or other prize substitution is permitted except at Sponsor’s discretion. The prize is nontransferable. Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes shall be the sole responsibility of the winner. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by winners is permitted. The prize is non-returnable. Acceptance of prize constitutes permission for Histoires de Parfums to use the winner's name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law.
7. Rights Granted by you: By entering this content you understand that Histoires de Parfums US, anyone acting on behalf of Histoires de Parfums US, or its respective licensees, successors and assigns will have the right, where permitted by law, without any further notice, review or consent to print, publish, broadcast, distribute, and use, worldwide in any media now known or hereafter in perpetuity and throughout the World, your entry, including, without limitation, the entry and winner’s name, portrait, picture, voice, likeness, image or statements about the Giveaway, and biographical information as news, publicity or information and for trade, advertising, public relations and promotional purposes without any further compensation.
8. Terms: Histoires de Parfums US reserves the right, in its sole discretion to cancel, terminate, modify or suspend the Giveaway should (in its sole discretion) a virus, bugs, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Giveaway. 9.  US may select the recipients from all eligible entries received prior to and/or after (if appropriate) the action taken by Histoires de Parfums US. Histoires de Parfums US reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Giveaway or website or violates these Terms & Conditions.
   Histoires de Parfums US has the right, in its sole discretion, to maintain the integrity of the Giveaway, to void entries for any reason, including, but not limited to; multiple entries from the same user from different IP addresses; multiple entries from the same device in excess of that allowed by Giveaway rules; or the use of bots, macros or scripts or other technical means for entering.
   Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Giveaway may be a violation of criminal and civil laws and should such an attempt be made, Histoires de Parfums US reserves the right to seek damages from any such person to the fullest extent permitted by law.
10. Limitation of Liability: By entering you agree to release and hold harmless Histoires de Parfums US and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such entrant’s participation in the Giveaway and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof, (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; (v) electronic or human error which may occur in the administration of the Promotion or the processing of entries.
11. Disputes: THIS GIVEAWAY IS GOVERNED BY THE LAWS OF THE UNITED STATES AND NEW JERSEY, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Giveaway, the participant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Giveaway, shall be resolved individually, without resort to any form of class action, exclusively before a court located in New Jersey having jurisdiction. Further, in any such dispute, under no circumstances will the participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys’ fees, other than participant’s actual out-of-pocket expenses (i.e. costs associated with entering this Giveaway), and participant further waives all rights to have damages multiplied or increased.
